Merry Christmas, Blessed Yule, Happy Kwanzaa, Happy Hanukkah, Fortuitous Festivus, Happy Holidays, and best wishes for prosperous, healthy, and fulfilling 2012 to all!

That said, on to the changes for 2012....

The other day, I went to my store, The Scraphouse, to upload a kit, only to find that the store had disappeared!!! This was the first I (or the other designers I've contacted) had heard of it being closed, so I've no idea what's going on!

If you want to buy any of my kits or image packs, send me an email, and I'll arrange payment via my Paypal account. Please use the title of the kit (They're all displayed on this blog, and -- unless noted otherwise -- are still only $1!) as the subject.

In January, I'll reopen my other blog, The Cat's Meow's Digital Scrapbooking Store, so that I have a place to sell whatever was at The ScrapHouse. (And anything new, also.) It will take a few days to set up, so watch this blog for an announcement of our "Grand Re-opening". I might even have a sale.... :D

I could use some help in setting up the new store! Please leave a comment on the type of vintage images you'd like to see in the new year. While I may not have everything you want, and I have limited time to work on things at the moment, I'll try to fulfill as many requests as I can during the year. I'll also be making paper packs, so if you have preferred colorways or themes, leave a comment on that, too.

Just to remind everyone, I'll be participating in the The Worldwide Christmas Blog Train again this year...but, having gotten terribly behind thanks to my trying to learn to use my recently-purchased PSP X4 -- which is not "quite" the same as good ol' PSP 9 -- I'm still working on things. I realize that my visitors are only here for the freebies. BUT, it's quite depressing to me, as a designer that -- even if you think my stuff is crap -- you don't leave a comment. And, it's even worse that those of you who like it also say nothing. I know you're all cheapskates who wouldn't buy a kit even if someone gave you a gift certificate, but I do this, pretty much, for the thanks I get...and those are far too few, too rarely given.

Yesterday I asked for comments on some new items I'm considering making. I've had several visitors who came here just to read that particular post...but no one bothered to comment!

What is the value that you all find in SILENCE???
You'll gladly take anything I offer for free, but most of you are too callous to even say "Thanks"!!!

Your continued lack of response, refusal to let me know what you'd prefer to see me make...makes me think I'm wasting my time!!!!!

Victorian Digistamps And More

Well, my sojourn at the tagging forum ended rather abruptly. It seems that taggers are rude, paranoid folks, for the most part, and interested mainly in enriching the coffers of people whom they pay for the "privilege" of using their wares to make items to give away for free. (Unlike scrap kits, a tag can't be used to make anything else. Once you've got it, all you have is a tag.)

So, I am BACK. I'm still thinking about new things to make and new ways to make use of what I've got. (I'm still a bit burnt out on tubing, however.) So, I'm considering maybe making digistamps from some of my images, altho -- since making them would be time consuming -- I'd probably have to sell only 1 or 2 in a pack for $1.

If you'd like to buy digistamps made from my vintage Victorian images -- or have a burning desire for any other vintage Victorian item (tell me what it is!) -- please leave me a comment!

New In Store: Angels Cherubs and Fairies Set 9

I finally got time to post this month's Angels Cherubs & Fairies set to The ScrapHouse. I've been really busy with a tagging forum that joined me on FB (I say it that way because I found out I'd "been joined to it" afterward, not by invitation like in the old Yahoo groups.) After only a week, I'm on staff (and it's not a small, nor a new, site -- so I'm amazed), which takes quite a bit of my time, but I seem to have more mojo for tagging than for tubing, at the moment. It's nice to be creative again!!!

I may go back to making Tagger versions of my image packs and kits. We'll see....

Here's my freebie for the Heartbeatz Creationz Blog Train called "Steampunk Flower Power". I really enjoyed making this one (and I even managed to make a kit to sell, also....something I don't usually do. It was posted to my stores yesterday. But, because of the rules for this train, you'll have to scroll back UP to find the preview...Blogger messed up the date on this post when I made a correction.)

It seems that everyone in the train made tagger size stuff, so I did, too. BUT, unlike most of the others, I also made a full-size version for my loyal fans! (Please leave a comment here if you either want to see more of my goodies in tagger-size OR you want to see me make items from predominately tagger-size trains in full-size also! It helps me know what to make in the future!)

Steampunk "Oil Lamp" Freebie

I was playing around today, trying to make things for the Heartbeats Creationz Blog Train that's coming next month. It's rather tricky, since I've never done anything (deliberately) within the theme we've been given, but here's what I came up with. This is based on a tut I found at http://blueshadowsmom.tripod.com/OilLampTutorial/index.html. I modified her instructions somewhat, but I used her scanned lamp hardware...and added a modern touch of my own: an LCD "flame" (not animated, sorry.)

This preview was my first-ever attempt at using the Perspective Shadow. It may be a little messed up...but your lamp doesn't have any shadows, unless you add them. I've included both a tagger and a full-size version in this freebie. I'd stopped making tagger items, because so few people download them here, but it seems that most participants in this train are doing tagger kits, so I hopped on the bandwagon, again. I'd like to join some new blog trains. If possible, I'd like to join some which, like the defunct Designer's Choice and ToXiK trains, have room for varying styles and tastes. Since I make altered art from Victorian Vintage sources as my main product, and would like to show it off, I need a venue that allows me to "fit in" better than I do with the very modern-style trains that seem to be running most of the time.

I inquired of the owner of Vintagerio.com for clarification of her TOU, just to make just to make sure I was correct in my interpretation. I won't bore everyone with the whole text of my email and her reply, but here's the important part of that reply:

You can use the ALTERED images for resale. What I meant was that I do not condone anyone that download my collection as it is and reselling it on another site as it is (without any alteration). Like i mentioned before that these are copyright free and royalty free images hence I do not claim any ownership of the images. But please do not resell it as it is . I hope I have cleared the confusion.

So, since I'm NOT in violation of Vintagerio's TOU , [and Dover Books TOU doesn't matter (but I wouldn't be violating it, either), since neither I nor Vintagerio is using nor has deliberately copied their Public Domain images], I shall continue to make tubes (extractions) and other items from these images to sell and give away.

[Just in case you're wondering, here's what "copyright free" and "royalty free" images are defined as:

Copyright-free is a conventional expression extensively used in Japan by authors whose works can be used freely regardless of copyright. It is distinguished from public domain but is not entirely a commitment to copyleft. (from Wikipedia)

Royalty-Free, or RF, in photography and the stock photo industry, refers to a copyright license where the user has the one-time right to use the photo without restrictions. The user can therefore use the image in several projects without having to purchase an additional license. RF licenses can not be given on an exclusive basis. (also from Wikipedia)]

Yet More On The Copyright Issue

Having been willing to work with me on the issue, the owner of one of my stores has received a reply from the owner of Vintagerio.com which states that there is NO duplication between her images and those of Dover Books. Until I request and obtain permission for my specific use -- which has lately come to include extensive reworking of the images, which should constitute "substantal alteration" (at the pixel level, often), as required for a derivative work -- I can't sell the tubes at her store. (Extractions are not all I create from these, however. I'll be asking her also about things with obvious substantial alteration.) I'll be seeking that permission soon; it will take a short time to create a portfolio of originals and my altered copies.

I am still awaiting a decision from my other store.

More On The Copyright Issue

In view of this weekend's accusations and my supposed violations of Dover Books' TOU for their published images, I will be posting this (and maybe several more) posts with additional facts about the issue. I resent being slandered and defamed by an uninformed person with an axe to grind, even if they DO own a store.

On Postcards & Ephemera

Firstly, people collect postcards and ephemera. You can buy them on eBay, and in many other places, both on- and offline. Secondly, in most cases, more than one copy of an item exists on the market, and the physical condition of such multiple items may vary widely. Dover Books generally does not own the sole available copy of any image in its collection.

On Images Produced Before 1923

This is a direct quote from the US Governent's own website for the Library of Congress :

The following facts are drawn from the circulars listed above:

· Works published or registered in the U.S. before 1923 are now in the public domain.

Explanation: According to the Copyright Act of 1976, works registered for copyright or published with a copyright notice were protected for a maximum of 75 years of copyright protection, assuming the copyrights on the works were renewed (28 years first term plus 47 for the second, if renewed). Public Law 105-298 enacted in October 1998 increased the maximum to 95 years [28 years first term and 67 for the second, if renewed]. Before 1998 the longest amount of time a work could be protected was 75 years, so works before 1923 were no longer protected (1998 minus 75 years equals 1923). When the law changed, the 1923 date was ‘frozen” and will remain so until 2018 [2018 minus 95 equals 1923]. Starting in 2018 the date that works are no longer protected will again change yearly, being calculated as the current year minus 95 years.(emphasis mine)

BOTH Dover and Vintagerio.com (the vendor that I purchased my images from) are reproducing images which were published PRIOR TO 1923. They both have the right to do so, and -- assuming that the images come from different cards that differ in condition, or from a retouched and an un-retouched image, or have some other difference -- these companies are not duplicating each other's efforts.

On Images Obtained From Outside The US

Again from the US Government's own site:

Foreign Works
For use within the United States:
Works published outside the United States before July 1, 1909 are considered to be in the public domain.
Works published outside the U.S. with a U.S. Copyright notice before 1923 are considered to be in the public domain.
Works made by the government of the United Kingdom (England, Scotland, Wales, Northern Ireland) and published more than 50 years ago are considered to be in the public domain.

(Also see this table, which is pretty self-explanatory.)

What is at issue is this:

Is an end-user (me) legally required to verify the right of a vendor (Vintagerio.com) to sell an image that may appear on casual inspection to be similar to an image sold by another vendor (Dover Books), but is NOT necessarily the same image, when such image is in the public domain, and when that end-user is unaware that the other vendor has published that image?

Does this liability extend to the point that said end-user must obtain licensing from multiple sellers of an item, even if the item they are using was one of several available and not a copy created from one vendor copying the merchandise of the other?

Does the end-user have a right to use images legally obtained from a vendor outside the US who is legally selling such images — which are Public Domain items in the US -- if a vendor in the US has published a similar image?

And when does said legal responsibility -- IF it exists -- give the right to someone who is possibly somewhat uninformed and has a personal issue with such use (the store owner who accused me of violating Dover's TOU for images that WERE NOT PURCHASED FROM DOVER and were sold by a private collector outside the US with a right to sell these Public Domain images) to slander me and make false accusations?

As I see it, I have done nothing which I did not have a right to do, as borne out by the above facts. Vintagerio is registered in Denmark, and the images they offer are legal to use in the US (and those which I have been able to verify a country of origin for WERE produced OUTSIDE THE US --added Feb.2. 2011 by me) so I have no conflict with Dover Books ....and, having bought these images in good faith that they were from a private collection outside the US whose items are in the Public Domain in the US, never did. [ Vintagerio and Dover Books -- by a great stretch of the details of the matter -- could, conceivably have a conflict. (But, that isn't my problem, anyway.)] However, Dover being the venerable old concern that it is, undoubtedly is aware that Vintagerio exists, and hasn't shut them down.

So, until and unless I hear from Dover Books formally that I must cease and desist from using these images -- and since my accuser never provided any proof to me other than Dover's TOU and her undocumented assertion that these images actually did belong exclusively to Dover and had been published in one of their books or cd compilations -- I shall continue to use them. I will not replace the images I have removed from this blog that were offered as freebies, however . (It would be a huge hassle to re-post them all.) I am still awaiting a decision from the owners of my other stores on whether or not they want to have my products created from these images in their stores.

Copyright Violations?

It seems I've been once again accused of doing something I had no way of knowing was wrong. Last year, I joined http://www.vintagerio.com, and purchased from them many images that were supposedly scans of the site owner's collected ephemera and postcards. Today, the owner of one of my (now former) stores contacted me, and stated that since ALL my images were copyrighted by Dover Books, I had no right to use them. (She also represented herself as an employee of Dover. I have no idea if this is true.) I found this rather odd, since I'd seen one of the Santas I used at Christmas in a picture of a postcard from a local collector's collection that was published in our paper. Did the paper violate Dover's copyright too, since they (Dover) apparently own "all" rights to that image?

I'm told that I can continue to use these images, to make websets (which I'd have to give away, they being something no one wants, since scrap kits are "the" thing, at the moment) or other unsellable junk...IF I buy a single use per image license from Dover. That doesn't seem right, that I have to PAY for a license, in order to make items no one wants, that I can only hope someone will take for free. Does it????

So, if you've downloaded anything "vintage" or "Victorian" from this blog, or purchased anything so labeled from any of my stores in the past year, it's probably violating Dover's copyright. You MUST immediately delete it from your computer....or the Copyright Police will come looking for YOU, too. (Seriously, PLEASE delete anything you've gotten from me (free or purchased) which has the word "vintage" in the image title -- it has come from a suspect source, and might get you sued if you use it.)

Please accept my apologies! I was completely unaware that the items I had purchased were anything other than what they were represented to be, and had no idea that Dover had copyrighted every vintage postcard and item of ephemera on the planet. Unfortunately for us all, this seems to be the case!!!

(Note: I have removed all images which might be contested from this blog and from my stores. It should be noted that, regardless of what you may hear from the owner of my former store -- and note that nowhere herein have I mentioned either her name nor that of her store -- I resigned from the store at first accusation and set about removing the "offensive" images BEFORE she "decided" to remove me...and I kept our emails as proof. So, the things she's saying and posting about me can be disproved!)

A Look Back...and The Promise of the View Ahead

The old year has ended. But, all in all, it was a GOOD year!

Last year, I planned to do two things: to join a site that offered public-domain (copyright-free) Victorian greeting cards and ephemera, and to join a site that would allow me to market finished layouts. Well, only one of those plans succeeded. I joined the vintage site (and you can see many items from that site in last year's posts) and was thrilled with all the merchandise I was able to store up -- and I expect the thousands of images will last me for several years of designing. I still can't make layouts that are worth bothering to look at, let alone use, however.

Another success was going from (I think) 9 followers to 40. It's great to know there a folks out there who appreciate my efforts and are interested in returning when I have new goodies for you. BUT, I DO wish more of you would leave comments!!!!! "Thanks!", "I love this!", and even the cryptic "TYVMFS" (and yes, I DO Know what it means -- so you needn't leave a comment about that) are what keep most of us designers going. (The lucky few get $$$ instead.)

I'm still doing blog trains, and still debating if most of them are worth the huge amount of effort (time) I usually spend in trying to make my vintage items and the things that I make by my own effort fit in with the scantily-clad posers and matchy-matchy "we all use the same items" things generated by most others. (That's not sour grapes; I think if my name is on it, I should be making most of the content myself, rather than just assembling it from things made by others...and most posers don't fit well with vintage art, it seems. As for the matchy-matchy, just what else is one to think when most of the kits in a train contain the same item(s), different only in color?)

That aside, I am hoping I can learn to use Poser this year. (DAZ refuses to install properly on my new computer, unfortunately.) Since Posers are THE most sought-after item in the scrapbooking world besides good scripts/actions, I should be making them (even if they are a departure from my usual style).

Now, on to some already successful plans for this year, 2011. I've joined several stores, and have had as many sales as can be expected in our current economy (not "none", but fewer than I'd have liked, as is true of most designers, in all my stores). But, thanks to buying the stores of WishingOnAStarr and Mad Hatter, I now have many beautiful items to offer. These 2 stores provided me with many wonderful design resources. Here's a sample of one thing I made with items I've bought from these fine designers:

I have a dozen or so packs of these lovely flowers to post, and I hope they'll give you many design possibilities. I've priced these inexpensively to make them more accessible to everyone, so be sure to take a look!

I also want to thank all my visitors this year! I started last year with about 9,000 visits since I opened this blog, and hit 25,000 this year on January 2. That's more than twice the visits of 2009!!! I'll be offering more freebies this year, so tell all your friends; I'd LOVE to see 75,000 visitors by next year!!!!!

Be sure to watch for a poll soon on new ideas for redecorating this blog! I'm redoing all my packaging in the stores, too (for example, all my CU graphics packs will have the white edging with aqua ribbon you saw in the sample above), and I'll be putting all the stuff in old packaging on sale until I get everything repackaged -- just as soon as I decide how to do that. (You never know...I might get crazy and do a "Buy My Store $1" deal...or I might opt for something saner. I'll let you know when I've set it up!)

A Word Of Warning About "Buy My Store" Deals

As most of you know, I rarely complain about anyone. Everyone has their own problems and reasons for acting as they do. And, in this case, I suppose I should have been more cautious, since the deal was good only until midnight of Dec. 31, 2010.... But, you don't expect a fellow designer to rip you off!

Anyhow, I bought a BMS deal from a popular designer (you can email me and I'll tell you who, but to prevent repercussions, I wont say her name on this page) at one of the more well-advertised stores. It was only $10, so I guess I really DID get my money's worth from the few things that were usable, but to find out that things represented as CU4CU in the store (by being so labeled) were only CU when the TOU was read, and having over half the items be corrupted downloads when I tried to open them (as well as "buying" 3 items that weren't even downloadable, because they had no download links in the Zen Cart) was disappointing, to say the least! (Especially after I emailed her and got a reply that said "I'll look into this and get right back to you; I really care about you getting everything you purchased"... but it's January 2, the deal has ended, and I've still heard nothing!!!) I might not feel so bad, since one expects this sort of thing to happen on the internet, but I can't even delete the corrupt files from my computer; Windows says it can't find them (but it pasted them in my folder), so they're stuck in my files, because Win 7 won't delete things it thinks don't exist!!! (So all those useless zips are just staring me in the face.)

I bought 2 other BMS deals over the holidays. The items in these were all as represented, and you'll be seeing them soon. I even managed to get some reseller graphics for you, and will be posting them to stores as soon as they're repackaged. I'm really grateful to the designers who provided me with the wonderful items (all of which downloaded successfully and are as represented); I'll have kudos for them in a later post.

I want to thank new follower Artzee Chris for indirectly helping me to find a source for lovely vintage blog sets. It's called Cute & Cool Blog Stuff. There are a lot of FREE sets, little odds and ends that can be used for decoration or navigation button-making, installation tips, and even instructions on how to make your own blog sets for the 2 column or 3 column Minima template. (I've hunted and hunted for good instructions on making Blogger Templates...so glad I finally found some!)

My newest item in stores this week (still being added to some) is a a set of 11 Santa tin tags, created from real vintage greeting card images. I've also included two hangers, a ribbon and a fancy gold chain with an ornamental snowflake hook.The tags are .pngs and the hooks are .pspimage and .psd with a layer to insert the tag. Both tagger and full-size versions are available. These can be used for CU/PU/S4H/S4O and CU4CU.

My friend, Funky, who you may know as Wishing-On-A-Starr, has a grandson named Cameron, He's a really cute kid, and he and Funky have a really special relationship. (She even created a website just for him.) But, Cameron lives with Autism....

However, there's recently been a ray of hope! Funky and Cam (and Cam's mom) want to attend a special intensive therapy program that he's already had some success with in England...but, the program is in Massachusetts (US). That's a loooonnng way from England. And, it's expensive! They have an ongoing program of fundraisers to get the money together for the 3 of them to attend.

Their latest project to generate funds is one that will appeal to many of you. It's a wonderful collab kit being sold at Butterfly Blush. I'm not associated with this store, but I think it's important to help out your friends, and this kit is awesome! So, won't you take a look and help this cute little guy get better? It's time again for the Designer's Choice Blog Train! This month, the theme is "Indian Rain". I think my 'Indians' were in Calcutta, rather than on the reservation, but I think you'll still enjoy this kit. The rich colors will go with every season, depending upon what you choose to use. The Blog Train kit is for taggers, but I made a FS kit as an Add-On.
I'd really like to encourage all my fellow designers to join this very friendly and supportive Blog Train! This is only our second month, but we have a lot of great palettes planned for the coming year, and there's room in this group for every design style.

Since Digifree seems to have forgotten that this blog exists, I signed up with CraftCrave. Maybe that will get me back into the loop.

They say that, in times of crisis, you learn who your true friends are. It appears that the true friend of this blog is Creative Busy Hands. Unlike Lori's Freebie List and Digifree/CraftCrave, CBH is referring me via their list, just like always. THANKS CBH!!!
